Guiding Opinions on Housing Security for International Talents.
In order to improve the service level and solve housing issues for talents, accelerate the implementation of the provincial talent-driven strategy, and advance the construction of the Hainan Provincial Pilot Free Trade Zone and the free trade port with Chinese characteristics, Hainan Province proposes the following Guiding Opinions on Housing Security for International Talents.
1. General requirements and fundamental principles
In order to implement the spirit of President XI Jinping’s keynote address on the 30th anniversary celebrations of the founding of Hainan Province and Hainan Provincial Special Economic Zone and The Guiding Opinions of the CCCPC and the State Council on supporting Hainan Province to Comprehensively Deepen Reform and Opening-up (CCCPC (20 1 8 ) No. 12), and implement the requirements of The Action Plan on attracting Millions of Talents to Hainan Province (2018-2025) (Hainan (2018) No. 8, hereinafter referred to as The Action Plan).
Hainan Province will actively create a favourable living environment for talents through building an excellent housing security system to attract various high-level talents from both at home and abroad for employment and entrepreneurship, and achieving the goal of “attracting, retaining and making the best use of talents,” for the purpose of providing strong talent support and intellectual security for the construction of Hainan Provincial Pilot Free Trade Zone and the free trade ports with Chinese characteristics.
Talents refers to master-level & outstanding talents, and other high-level talents in accordance with the requirements of The Action Plan and Hainan Province High-level Talent Classification Standard (2017) accredited by the provincial-level functional departments, full-time graduates with a masters, bachelor or junior college degree, and talents with intermediate professional and technical title or above, or professional technician qualifications or practicing qualifications or above.
Talent apartments are only provided for master-level, outstanding talents and leading talent who arrived after 13th May, 2018.
Standards for apartment sizes for various talents are as follows: no more than 200 m2 for the master-level talent, no more than 180 m2 for the outstanding talent, and no more than 150 m2 for the leading talents.
The talent apartment will be rent free for 8 years, (8O% paid by the government to the talent who completes a full-time job for 5 years and 100% for 8 years.)
The talent apartments, based on the local responsibility system, are built, purchased, distributed and managed by city or county government.
The talent apartment for the above-mentioned high-level talents who are sourced by provincial public institutions will be funded by the provincial finance department through transfer payment, and entrusted to local city or county government for integrated arrangements.
Housing rent subsidy and house-purchasing subsidy
The housing rent subsidy and the house-purchasing subsidy shall be distributed to talents who arrived after 13th May, 2018, including top talents and other high-level talents below 50 years old (the age restriction can be relaxed for urgently-needed talents), full-time master graduates below 40 years old, full-time bachelor graduates below 35 years old and talents with intermediate professional and technical titles and above.
Full-time graduates who have graduated from Hainan provincial general institutes of higher education in or after 2018 shall refer to the above provisions.
The time period for payment of housing rent subsidies shall not be more than 36 months. The housing rent subsidy will be distributed once per quarterly uniformly, the guiding standard for such subsidy is as follows:
5000 Yuan/month for top talent, 3000 Yuan/month for other high-level talent (including urgently-needed technical talents), 2000 Yuan/month for master graduate or talents with intermediate professional and technical title, and 1500 Yuan/month for bachelor graduate.
The time period for payment of the house-purchasing subsidies shall not be more than 3 years. The house-purchasing subsidy will be distributed once per year uniformly.
The guiding standard for such subsidy is as follows:
60,000 Yuan/year for top talents, 36,000 , Yuan/year for other high-level talent (including urgently-needed technical talents), 24,000 Yuan/year for master graduate or the talent with intermediate professional and technical title, and 18,000 Yuan/year for bachelor graduate.
Talent who have received the house-purchasing subsidy shall not be eligible for the housing rent subsidy.
Talents who have received the housing rent subsidy prior to receiving the house-purchasing subsidy shall be deducted the received housing rent subsidy.
Talents shall apply for the housing or rent subsidy and the house-purchasing subsidy through their employer, and submit required personal materials. The employer shall be responsible for authenticity and integrity of application materials and issue a letter of commitment and good faith, declare the application material to their local “one-stop” talent service platform, and submit it to the local bureau of human resources development for review; the provincial public institution shall declare the application material to the provincial “one-stop” talent service platform, and submit it to the Hainan Provincial Bureau of Human Resources Development for review.
Upon approval, the Bureau of Human Resources Development at all levels will review and distribute the housing rent subsidy on a quarterly basis and the house-purchasing subsidy on a yearly basis to the employers, and then the employers distribute them to the applicants.
Talents who apply for the housing rent subsidy or the house-purchasing subsidy shall provide the following materials:
Talent-related certificate materials (high-level talent shall provide related materials accredited by provincial-level functional departments, all other talents shall provide personal academic certificates, diplomas or personal title certificates), individual income tax or social insurance payment certificates corresponding to the application time intervals, housing lease contract or house-purchasing contract registered with the local housing administration department, employment (labour) contracts, etc.
Self-employed without an employment (labour) contract shall provide their industrial and commercial business license.
The housing rent subsidy and house-purchasing subsidy for talents in public institutions related to the public welfare (Class-I and Class-II) shall be funded in full by the financial government bodies at all levels according to the subordination of organization; the subsidies in the public institutions related to production and management shall be funded by the financial government bodies at all levels and the employer with the ratio of 1 : 1 according to the subordination of organization.
The enterprise subsidy shall be funded by the financial government body at city or county level and the employer with the proportion of 1:1 according to the principle of local jurisdiction.
Civil servants and staff who are managed according to Civil Servant Law of the People’s Republic of China shall not be incorporated into the scope of security, including talent apartment, housing rent subsidy or house-purchasing subsidy.
(3) Purchasing commodity housing
Talents who purchase commodity housing as of the date of settlement in Hainan shall enjoy the same treatment as local residents. Accredited high-level talents shall also enjoy the same treatment as local residents.
4. Organizing & implementation
(1) Implementing a target-oriented responsibility system
Housing security for international talents is based on the target-oriented responsibility system: “provincial government is responsible for its integrated planning, and city or county government is responsible for the implementation”.
City or county governments and related provincial government bodies shall, under the unified leadership of Hainan Provincial Party Committee and Hainan Provincial People’s Government, implement the requirements of The Action Plan according to the principle of integrated planning and implementation.
The housing security for international talents is characterized by its widely involved aspects and strong policy factors; therefore, the government bodies at all levels, in such sectors as Talent Office, Development and Reform, Planning, Finance, Human Resources and Social Security, Land and Resources, Housing and Urban-Rural Development, etc. shall, under the leadership of the party committee and government at the corresponding level, perform their own functions and act in close coordination to accelerate the tasks related to the housing security for international talents
(2) Implementing, planning and plan management
The provincial government shall organize city or county governments and related provincial government bodies to work out the plans for housing security for talents and the annual implementation plans at the province, city and county levels according to the talent acquisition plan and newly-employed population size, and then proceed with implementation.
Housing construction for talents shall be incorporated into the annual plan of land use and planning and construction application plan, and listed separately upon declaring the annual land use indicators. Upon assigning annual land supply indicators, the land use demand on the housing construction for talents shall be guaranteed as a priority.
(3) Increasing housing supply for talents
Cities and counties shall raise the housing resources for talents through various channels, such as government-funded acquisition, long-term lease or unified construction, development and construction based on governmental organization and market operation, self-owned housing, etc. Employers shall be encouraged to make use of their self-owned land to build rental housing for their own International talents in accordance with planning conditions. Problems with housing security for talents shall be solved through researching and exploring the application of market mechanism.
5. Other requirements
(1) Cities and counties shall, according to the spirit of The Guiding Opinions, and based on the actual situation, such as local housing rent level, commodity housing price, etc., reasonably determine specific housing rent subsidy and house-purchasing subsidy standard for talents, and work out the implementation rules on the housing security for imported talents and organize implementation.
(2) The human resources departments at all levels shall, based on “one-stop” talent service platform, implement “one-stop acceptance, one-time notification, one-package service” for application, review, allocation or distribution of talent apartments, housing rent subsidy and house-purchasing subsidy, strengthen the supervision and management of work related to the housing security for talents, and promote the service level of the housing security for talents.
(3) Human resource departments at the provincial level shall accelerate the building of a credit system for housing security for international talents, and incorporate it into the National Credit Information Sharing Platform (Hainan) to enhance credit management. If housing rent subsidy, house-purchasing subsidy or physical housing are obtained by fraudulent means in violation of the provisions, organizations and individuals shall be held liable according to laws and regulations, listed into “credit blacklist”, and punished severely by governmental departments in such sectors as industry and commerce, tax, finance, etc.
(4) Housing with joint property rights, restricted commodity housing or commodity housing that talents have purchased can be transferred 5 years after the real estate warrant has been obtained, and the transferee also must satisfy corresponding house-purchasing conditions.
(5) The housing security policies for various talents who have been working in Hainan Province before 13th May, 2018 shall be otherwise specified through further research.
(6) Department of Housing and Urban-Rural Development of Hainan Province and Department of Human Resources and Social Security of Hainan Province shall be responsible for the explanation of The Guiding Opinions.
(7) The Guiding Opinions shall take effect as of the date of its issuance.
