Application, issuance, supervision and management of seed production and operation licenses for the Hainan Free Trade Port

Recently, Hainan issued the Administrative Measures for the Production and Operation Licensing of Seed Imports and Exports in the Hainan Free Trade Port

In accordance with the decision of the Standing Committee of the National People's Congress on Authorizing the State Council to temporarily adjust the application of relevant laws and regulations in China (Hainan) pilot free trade zone and the overall plan for the construction of Hainan free trade port, provisions have been made on the application, issuance, supervision and management of seed production and operation license of the Hainan free trade port.

The agricultural, rural and forestry departments of Hainan Provincial People's government are respectively responsible for the examination and approval and supervision of the seed production and operation license (hereinafter referred to as the seed production and operation license) for the import and export business of crop seeds and forest and grass seeds.

In applying for a seed production and operation license, the application materials shall be submitted to the service window of the government affairs service centre of the provincial people's government or in Hainan government affairs service network.

The production and operation licenses for crop seeds and forest and grass seeds shall be examined and issued by the agricultural and rural and forestry authorities of the provincial people's government respectively.

Application conditions

Have a fixed office space in the Hainan free trade port;

Have the ability to perform quality inspection;

Necessary processing equipment;

Have supporting storage facilities;

Have professional technical personnel;

Must be legally operated varieties;

Other conditions prescribed by the competent department of agriculture, rural areas, forestry and grassland under the State Council;

When applying for seed production and operation license, a foreign-funded enterprise shall not only meet one to seven requirements, but also comply with the relevant provisions of the negative list.

Note: Those engaged in the import and export business of crop seedlings and forest and grass seedlings shall meet the following conditions in addition to the above-mentioned conditions:

Have isolation facilities commensurate with the scale of production and operation;

Have disinfection facilities such as high temperature sterilization.

Application materials

Application form for seed production and business license;

Explanatory materials for office space, quality inspection capabilities, processing equipment, storage facilities, and operating varieties;

Explanatory materials for the basic conditions of technical personnel in seed production, processing, storage, and inspection;

A written commitment letter shall also be submitted if the notification commitment system is adopted.

Validity period of license.

The term of validity of the seed production and operation license is 5 years.

If a crop seed production and operation licensee continues to engage in seed production and operation after the expiration of its validity period, the producer or operator shall file a new application six months before the expiration of the validity period.

If the license for the production and operation of forest and grass seeds needs to be renewed upon expiration of its validity, the producer or operator shall file a new application 30 days before the expiration of the license.
