29 measures to optimize the business environment in Hainan, plus time frames & responsible units

The Action Plan proposes 29 reforms in 11 key areas, including starting a business, obtaining construction permits, obtaining telecommunications services, registering property, obtaining credit and improving the financing environment, facilitating taxation, cross-border trade, and protecting investors.

It aims to help Hainan accelerate the formation of rule of law, internationalization, and facilitation of the business environment, and promote the construction of the Hainan Free Trade Pilot Zone and the free trade port with Chinese characteristics. 

The Action Plan also clarifies the responsible units and time limits for completion of various reform initiatives.

Starting a business in Hainan

Expand the “separation of licenses” reforms and the scope of reforms in the fields of tourism, modern service industries, and high-tech industries.

Promote the innovation of “Mobile Internet + Government Affairs”, and integrate the web-site and mobile government services, and create a unified government service portal that covers the functions of various departments and opens up cross-departmental data for one “all island” Netcom Office.

Increase the opening of key industries and promote cooperation and innovation between Hainan, Hong Kong and Macao. Taking key industries such as the Internet and culture as breakthroughs, innovate regulatory measures to enhance the level of comprehensive law enforcement.

Obtain a construction permit

Cancel construction drawing reviews for construction projects that meet certain conditions, and explore a “Designer Lifelong Responsibility System”.

Relax conditions for the admission of architectural and engineering design firms in Haikou, Sanya and other areas in Hainan, and encourage the support of domestic and foreign first-class architectural and engineering design firms to establish branches, and support the joint arrangement of foreign firms and domestic qualified design firms.

Promote the development of the consulting service industry in the field of engineering construction.

Explore and implement the cooperation between “standard land + commitment system + agency system” in the key industrial parks in Hainan Province.

Access to electricity and telecommunications services

Promote the construction of the Hainan international submarine cable, and provide the network infrastructure for Hainan’s participation in the digital economy and information technology cooperation along the “Belt and Road” in Guangdong, Hong Kong and Macao with the help of international submarine cables to Hong Kong and other places.

Expand the construction of 5G sites in the province, accelerate the promotion of 5G network coverage throughout the island, and comprehensively carry out 5G commercial network and construction to form a 5G demonstration area.

Optimize the power management process, improve the power supply service level, and reduce the power-down time as well as reduce the cost of power-supply. 

Achieve a low-voltage power supply of 100-200 kVA for small and micro enterprises in all prefecture-level cities in Hainan Province.

Fully develop the smart grid, improve the reliability of the power supply, and achieve an average power outage time of the province’s electricity customers to be within 15 hours.

Property registration

Improve the network level of real estate registration, and pilot and promote online payment of real estate registration fees.

Promote data sharing between real estate registration agencies and banks, promote the establishment of interactive real estate registration convenience service points in the province, and promote “one-stop” real estate mortgage loans and mortgage registration services at pilot bank outlets.

Explore the establishment of a blockchain real estate registration model, and gradually develop the link between real estate registration and multi-sector data.

Gaining credit and improving the financing environment

In combination with local business practices of Hainan, establish a whitelist system for customers, carry out pilot reforms for the integration of local and foreign currency accounts, and implement the FT account system design of “first-line convenience, second-line management” to promote free flow of capital and free convertibility of currencies.

Build a credit information sharing platform for the free trade pilot zone to achieve multi-sector information sharing and integration, formation mechanism and normalization tracking.

Innovative bank-financing services, accelerate the construction of an integrated financial service platform, expediate various resources such as government, banking, taxation, and guarantees, etc., Integrate government procurement contract financing functions, and build a one-stop financial service enterprise platform for small and medium-sized enterprises to establish a convenient financing environment.

Establish an integrated promotion system for SMEs’ with government, industry and finance, and provide multi-level, multi-channel and low-cost services for the establishment and development of SMEs. (Responsible unit: Provincial Department of Industry and Information Technology; time limit for completion: June 2020)

Taxation facilitation

Comprehensive development of a “one-door, one-network office”, “one-time operation” provincial administration system, while continuously updating the list of taxation issues, and promoting coverage throughout the province.

Establish online services for main tax-related issues.

Cross-border trade

Develop and publish a negative list of cross-border service trade in Hainan, and further enhance Hainan’s internationalization level in the fields of modern service such as medical care, education, and internet and business services.

Continue the development of a “single window” for international trade, develop and improve the business function sections with Hainan characteristics such as tax exemption on the outlying islands, and realize the interconnection of data between government departments, port supervision units, banks and enterprises.

Continue the reform of customs business allowing enterprises to independently select “one-time declaration, step-by-step disposal” and “two-step declaration” to improve the level of port supervision services, international trade convenience and safety.

Establish and improve the “three-stream” big data precision management and control information system for people flow, logistics and capital flow into and out of the island.

Protect investors

Establish and improve the expert jury system, the technical investigator system, and the pool of experts in intellectual property trials, and further improve the technical fact finding mechanism for intellectual property cases.

“Protect innovation in an advanced way”, explore cutting-edge technologies such as artificial intelligence and big data, and introduce a smart trial system in the province to improve the fluency and efficiency of trials.

Execution contract

Promote the development of diversified dispute resolution methods. Utilise professional colleges and oversea’s laws to identify the resources of institutions, cooperate to build a professional third-party identification platform for extraterritorial law; promote the establishment of a sound “open” entrusted mediation mechanism, develop a pilot program for online mediation, and develop and use an online mediation platform.

On the basis of the judicial credit inquiry, implement a hierarchical management of the judicial risk system within the courts of the province, conduct dynamic tracking and research on the key risks involved in the judiciary, and promote scientific, intelligent and precise warning of judicial risks.

Dealing with bankruptcy

Clarify the bankruptcy administrator’s compensation determination and withdrawal management system, explore the establishment of a bankrupt management association and the bankruptcy fee protection fund and protect manager’s reasonable income rights.

Explore the implementation of a diversified bankruptcy mechanism and simple review of bankruptcy procedures for different cases.

Building a service-oriented government

According to the industrial orientation of each park, implement a “one park and one policy”, system. Innovate the management systems and mechanisms of the park, improve the operation mode of “statutory institutions + market entities”, and promote the park to become a legal, international and convenient first-class business environment window.

The policy measures proposed in this Action Plan, where any adjustments to existing laws or administrative regulations are involved, shall be implemented after being authorized by law.
