Guidelines to Auctioneer Professional Qualification Examination for Overseas Personnel

General provisions

Article 1 This guideline is formulated in accordance with the administrative measures for overseas personnel to the Hainan Free Trade Port to participate in the vocational qualification examination (trial implementation), the work plan for implementing the negative list of Cross Border Service Trade in Hainan Province, and the professional qualification examination for auctioneers in the People’s Republic of China. These guidelines are formulated in combination with the actual situation in Hainan Province.

Article 2 These guidelines are applicable to overseas personnel who legally work or reside in the Hainan Free Trade Port or are willing to work and stay in the Hainan Free Trade Port, as well as overseas students (hereinafter referred to as overseas personnel).

Article 3 The “Auctioneers Professional Qualification Certificate of the People’s Republic of China (Foreign Persons)” (hereinafter referred to as the “professional qualification certificate for auctioneers”) obtained by overseas personnel through examination shows that they have the necessary technology and ability to engage in the auctioneer and auction business, which is valid in the Hainan Free Trade Port area.

Chapter II Registration for examination

Article 4 Foreign personnel taking the auctioneer professional qualification examination in the Hainan Free Trade Port shall have the same examination standards, unified organization of examinations, and unified issuance of certificates as domestic candidates.

Article 5 All overseas personnel who abide by the laws and regulations of the People’s Republic of China, abide by professional ethics, has full capacity for civil conduct, has a college degree or bachelor’s degree or above recognized by the People’s Republic of China, and has good conduct, can voluntarily sign up for the professional qualification examination of auctioneers.

Anyone who has had the auctioneer’s qualification certificate revoked for less than 5 years, in the past year has participated in the auctioneer’s qualification examination, violated the rules and was suspended from the examination, or has received criminal punishment for intentional crime shall not register for the auctioneer’s qualification examination.

Article 6 To register for the auctioneer professional qualification examination, overseas personnel should submit the following materials:

(1) A college degree or above from a domestic university or a bachelor’s degree certificate or above, or a college degree or above from an overseas university recognized by the education administrative department of the People’s Republic of China.

(2) Valid identity certificates such as valid passports, visas or permanent residence ID cards for overseas personnel.

(3) Other relevant materials.

Article 7 For overseas personnel to participate in the National Auctioneer Professional Qualification Examination, online registration shall be adopted. Sign up on the website of the China Auction Industry Association (www.caa123.org.cn) with your valid ID information (valid passport, visa or permanent residence ID card for overseas personnel). Information on examination notices, registration, syllabus and teaching materials can be found in the announcement section on the website.

Article 8 The China Auction Industry Association is responsible for the qualification examination of overseas candidates. For those who pass the qualification examination, the examination permit shall be issued by the China Auction Industry Association. Overseas candidates can log in to the online registration system to print their admission cards and take part in the examination with a valid ID card and admission card according to the time and place indicated on the admission card.

Article 9 Overseas personnel participating in the professional qualification examination of auctioneers shall abide by the examination rules and relevant regulations. Personnel who violate the examination rules and relevant regulations shall be dealt with in accordance with the national regulations on the handling of violations of rules and regulations in the qualification examination for professional and technical personnel.

Chapter III certificate management

Article 10 If overseas personnel have passed the professional qualification examination for auctioneers, they shall be issued with a professional qualification certificate for auctioneers issued by the Ministry of Human Resources and Social Security and printed by the China Auction Industry Association. The certificate shall be marked with “effective area: Hainan Free Trade Port”.

Article 11 The China Auction Industry Association will issue qualification certificates to those who pass the examination and announce the list of foreign personnel to the public. The Department of Commerce of Hainan Province is responsible for reporting the list of certificates to the Talent Development Bureau of the Hainan Provincial Committee of the Communist Party of China for the record.

Chapter IV supplementary provisions

Article 12 Hong Kong, Macao and Taiwan residents shall take the professional qualification examination for auctioneers in the Hainan Free Trade Port in accordance with the relevant provisions of the state.

Article 13 A standard charge for the professional qualification examination of overseas trade practitioners in the Hainan Free Trade Port shall be implemented.

Article 14 The Hainan Provincial Department of commerce is responsible for the interpretation of the guidelines.

Article 15 This index shall come into force as of the date of issuance and shall be valid for 3 years.
